Background Screening Policy

Effective Date: January 1, 2025

1. Introduction This Background Screening Policy (“Policy”) outlines the terms governing all background screening services (“Screening Services”) provided by GCheck, LLC (“we,” “us,” “our,” “GCheck”). This Policy is incorporated into the GCheck Terms and Conditions. By using our Screening Services, you (“Client,” “you,” “your”) agree to the terms outlined in this Policy.

2. Compliance with Laws GCheck operates as a “consumer reporting agency” (“CRA”) as defined in the Fair Credit Reporting Act (FCRA), 15 U.S.C. ยง 1681 et seq., and applicable state laws. Any report provided to you by GCheck for a permissible purpose under the FCRA is a “consumer report” and/or “investigative consumer report” (“Screening Report”). The FCRA imposes criminal penalties against anyone who knowingly and willfully obtains information on a consumer from a CRA under false pretenses, including fines, imprisonment, or both.

3. Client Responsibilities

3.1 Permissible Purpose Clients must certify that Screening Reports are requested solely for permissible purposes under the FCRA, such as employment screening.

3.2 Disclosure and Authorization Before initiating a background check, Clients must:

  • Provide the consumer with a clear and conspicuous disclosure, in a document consisting solely of the disclosure, that a consumer report may be obtained for employment purposes.
  • Obtain the consumer’s written authorization to procure the report.

3.3 Adverse Action Procedures If considering adverse action based on a Screening Report, Clients must:

  • Provide the consumer with a pre-adverse action notice, including a copy of the Screening Report and a summary of their rights under the FCRA.
  • Allow the consumer a reasonable period to dispute the information (typically five business days).
  • If proceeding with adverse action, provide the consumer with an adverse action notice containing the required information.

4. Information Security Requirements Clients must:

  • Implement appropriate security measures to ensure that only authorized individuals with a legitimate business need can access Screening Reports.
  • Access Screening Reports only from authorized devices secured with a password or passcode; public or shared computers must not be used.
  • Ensure physical copies of Screening Reports are securely shredded once no longer needed and applicable data retention requirements permit destruction.
  • Ensure digital copies of Screening Reports are securely deleted once no longer needed and applicable data retention requirements permit destruction, and that electronic devices used to store digital copies are securely erased, overwritten, or scrambled to prevent recovery.

  • California Residents: You have the right to view your file held by a Consumer Reporting Agency. By providing proper identification and paying duplication costs, you may obtain a copy of this information in person during regular business hours, by mail, or by phone. The Consumer Reporting Agency can assist you in understanding your file, including coded information.

6. Changes to This Policy We may update this Policy at any time. Continued use of our Screening Services after changes constitutes acceptance of the revised Policy.
