PartnerStack Program Terms of Service

Effective Date: August 1, 2026

These Terms of Service govern participation in the GCheck PartnerStack Program. GCheck operates under Compliance for Good™, our commitment to background screening built on three pillars: Transparent Compliance, Fair Compliance, and Protective Compliance. We ask our partners to promote GCheck in a way that reflects those same standards. By enrolling in the program through PartnerStack, you agree to the terms below.

1. Definitions

  • GCheck means GCheck, LLC, the company operating the GCheck background screening service.
  • Partner (or “you”) means the individual or organization approved to participate in the program.
  • PartnerStack means the third-party platform used to manage enrollment, referral tracking, commission calculation, and payouts.
  • Referral Link means the unique tracking link or code assigned to you through PartnerStack.
  • Referred Prospect means a prospective customer who reaches GCheck through your Referral Link and who is not already a GCheck customer, an active opportunity, or an existing contact in GCheck’s pipeline at the time of referral.
  • Qualified Demonstration means a scheduled GCheck product demonstration that is attended and completed by a Referred Prospect who meets GCheck’s eligibility criteria as described in Section 4.
  • Signed Contract means a fully executed service agreement between GCheck and a Referred Prospect who became a customer.

2. Eligibility and Enrollment

Participation is open to individuals and organizations that complete enrollment through PartnerStack and are approved by GCheck. GCheck may approve or decline any application at its discretion. Employees, contractors, and immediate family members of GCheck are not eligible to earn commissions on referrals to their own employer or organization.

You are responsible for the accuracy of the information in your PartnerStack account, including tax and payment details. GCheck may request additional verification before approving your account or releasing payment.

3. Referral Tracking and Attribution

Referrals are tracked through your Referral Link inside PartnerStack. A Referred Prospect must reach GCheck through your Referral Link for a commission to be attributed to you. Attribution follows a 90-day tracking window from the Referred Prospect’s first click, subject to PartnerStack’s tracking capabilities.

Where more than one partner could claim the same prospect, GCheck applies last-touch attribution as recorded by PartnerStack. GCheck’s records, together with PartnerStack’s tracking data, are the authoritative source for attribution and commission decisions. A prospect already present in GCheck’s pipeline before your referral is not eligible for commission.

4. Commission Structure and Qualifying Events

The program pays a total of $150 for each customer acquisition, earned across two milestones:

To qualify for the Completed Demo milestone, a Referred Prospect must:

  • Represent a US-based organization with a genuine hiring or background screening need;
  • Attend and complete a scheduled demonstration with a GCheck representative;
  • Be a net-new prospect not already known to GCheck, as described in Section 3;
  • Provide accurate contact and company information.

A commission is not earned for demonstrations that are scheduled but not attended, for prospects who do not meet the criteria above, or for demonstrations later found to be fraudulent, self-referred, or artificially generated. GCheck confirms each qualifying event before a commission is approved in PartnerStack.

5. Payment Terms

Approved commissions are paid through PartnerStack according to PartnerStack’s standard payout schedule and methods. Commissions are calculated in US dollars.

  • Commissions are approved after GCheck confirms the qualifying event.
  • A minimum payout threshold of $50 may apply before funds are released, per PartnerStack settings.
  • You are responsible for any taxes owed on commissions you receive. GCheck does not withhold taxes on your behalf.
  • GCheck is not responsible for payment delays caused by incomplete account information, failed tax verification, or PartnerStack processing.

6. Clawbacks and Adjustments

GCheck may reverse or withhold a commission when:

  • A qualifying event is later found to be invalid, duplicated, or the result of prohibited activity;
  • A Signed Contract is canceled, voided, or terminated within 30 days of signing, or fails for non-payment;
  • A demonstration or contract is determined to be fraudulent or self-referred.

Where a commission has already been paid, GCheck may offset the amount against future commissions or request repayment.

7. Partner Obligations and Honest Promotion

GCheck is a compliance-forward brand, and we hold our partners to the same standard we set for ourselves. When promoting GCheck, you agree to:

  • Clearly and conspicuously disclose your affiliate relationship with GCheck wherever you promote the program, consistent with US Federal Trade Commission endorsement and disclosure guidance;
  • Represent GCheck’s products and pricing accurately and only as described in official GCheck materials;
  • Avoid any claim that GCheck guarantees hiring outcomes, legal compliance results, or specific screening findings;
  • Comply with all applicable laws, including those governing advertising, email, privacy, and data protection.

8. Prohibited Activities

The following activities are not permitted and may result in withheld commissions or removal from the program:

  • Self-referrals, or referrals of prospects you control or are affiliated with, for the purpose of earning commissions;
  • Unsolicited bulk email, spam, or messaging that violates applicable law or platform rules;
  • Bidding on GCheck trademarks or brand terms in paid search, or registering domains that include GCheck brand terms;
  • Impersonating GCheck or presenting yourself as an employee, agent, or official representative of GCheck;
  • Making false, misleading, or disparaging statements about GCheck or any other company;
  • Cookie stuffing, forced clicks, or any method that generates referrals without genuine prospect intent;
  • Publishing GCheck content on sites containing unlawful, discriminatory, or harmful material.

9. Use of GCheck Brand and Marketing Assets

GCheck grants you a limited, non-exclusive, revocable license to use approved GCheck names, logos, and marketing assets solely to promote the program during your participation. You may not modify GCheck marks or create derivative marketing that implies partnership, endorsement, or employment beyond your role as a program partner. All GCheck brand rights remain with GCheck. This license ends when your participation ends.

10. Confidentiality

You may receive non-public information through the program, including pricing, product details, and prospect data. You agree to keep this information confidential, to use it only to promote GCheck under these terms, and to handle any prospect or customer data in line with applicable privacy laws. You may not retain or reuse prospect data for your own purposes.

11. Term, Modification, and Termination

These terms remain in effect while you participate in the program. GCheck may update the program, including commission amounts, qualifying events, and these terms, on a going-forward basis. Material changes will be communicated through PartnerStack or by email. Continued participation after a change means you accept the updated terms.

Either party may end participation at any time, with or without cause. On termination, your Referral Links are deactivated and your license to use GCheck brand assets ends. Commissions for qualifying events that were validly earned and confirmed before termination remain payable, unless termination is for prohibited activity or fraud.

12. Independent Contractor Relationship

You participate as an independent contractor. Nothing in these terms creates an employment, agency, partnership, or joint venture relationship between you and GCheck. You have no authority to bind GCheck or to make commitments on its behalf.

13. Disclaimers and Limitation of Liability

The program is provided on an “as is” basis. GCheck does not guarantee any level of referrals, conversions, or earnings. To the fullest extent permitted by law, GCheck is not liable for indirect, incidental, or consequential damages arising from your participation. GCheck’s total liability under these terms is limited to the total commissions paid or payable to you in the three months before the event giving rise to the claim.

14. Governing Law

These terms are governed by the laws of the State of California, without regard to conflict of law principles. Any dispute arising from the program will be resolved in the courts located in California.
